TERMS OF USE MAINETBALL PERFORMANCE PROGRAMME (MNPP)

Eligibility and Registration

The services included in MNPP are not available to participants under the age of 18 or those who do not have the legal capability to be bound by these terms unless they are supervised by a parent or legal guardian (supervisor). The supervisor must have registered, paid, read and agreed to the MNPP terms of use. By registering, accessing and using MNPP you agree that you’re at least 18 years of age or the supervisor of the participant, and are bound by these terms.

Members under the age of 18 or without legal capacity (minor)

Minors may access and use MNPP under the supervision of their supervisor. The supervisor must be registered in order for the minor to access these services in accordance with these terms. The account name and email entered on the registration form should belong to the supervisor not the participant.

If you’re the supervisor registered for MNPP, you acknowledge that you’re giving consent for the participant to use the services and that you’ll supervise the participants use of the services at all times. It’s the supervisors responsibility to ensure that the participant complies with these terms.

Communication

By registering to MNPP you are agreeing to the receipt of communications from Maias Group Ltd through the email address associated with the account. You're also agreeing to direct communication from Maias Group Ltd to the participant via our secure online chat platform.This method of communication is not visible to other members and is only accessible through your personal MNPP homepage.

There will be opportunities for members to post comments on shared online spaces e.g. live virtual sessions or blog posts. By agreeing to these terms, you’re acknowledging that when using theses services participants will be able to see other member communication and any form of communication participants choose to make will be visible to other MNPP members. Should communications on this platform be deemed inappropriate Maias Group Ltd reserve the right to remove comments and restrict, suspend or terminate your access to MNPP. This does not entitle you to a refund.

Live Sessions

Members will have access to live virtual sessions via external platforms (e.g. Zoom). Should participants choose to join these sessions they will be able to see, be seen and communicate with other members. Agreeing to these terms acknowledges that participants can communicate with each other without the knowledge of Maias Group Ltd. Should communications on this platform be deemed inappropriate Maias Group Ltd reserve the right to remove comments and restrict, suspend or terminate your access to MNPP. This does not entitle you to a refund.

Live sessions may be recorded and used on social media platforms to promote Maias Group Ltd products. By signing up to MNPP you agree to the use of participants image for Maias Group Ltd promotional materials.

Access and Payments

It’s the participants responsibility to make the necessary arrangement to have access to the services provided on MNPP. This includes access to the appropriate tools such as internet access, smart devices and equipment.

When signing up to MNPP you will be required to pay the advertised subscription fee in advance. This subscription fee will be billed automatically to your agreed payment method at the start of each 12 or one month period (unless cancelled before the annual/ monthly period). The fee for each billing period will remain the same unless notified well in advance.

If we’re unable to process payment for the subscription we reserve the right to terminate you membership and access to MNPP. We reserve the right to increase the MNPP subscription fee at any time given reasonable and advance notice to you.

Cancellation

By registering to MNPP you’re acknowledging that you have instant access to the digital service. Once you’ve accessed a monthly or annual subscription you lose the right to cancel within 14 days for a full refund. Partial refunds are available for annual subscriptions within the 14 day cancellation period. You can cancel your subscription within the 14 days by contacting enquiries@maiasnetball.com.

You’re free to cancel your subscription at any other time by notifying us via enquiries@maiasnetball.com. If you choose to cancel your subscription your access to MNPP will end once the cancellation has been processed. This does not entitle you to a full refund.

Suspension or termination of use

Maias Group Ltd reserve the right to restrict, suspend or terminate your access to MNPP at any time with due cause. This does not entitle you to a refund.

Intellectual Property Rights

If you agree to these terms Maias Group Ltd grants you access to the materials and services included within MNPP for the sole use of the participant and their supervisor. You must not modify, copy, distribute, publish or commercially exploit any content within MNPP without our written approval. If the user is found to have breached MNPP’s intellectual property rights their account will be immediately terminated. This may result in the participant and supervisor being banned from all Maias Group Ltd services and legal action may be taken.

DISCLAIMER - Medical and personal injury

Exercises and activities within MNPP may not be suitable for everyone and you should always work within your own capabilities at a level that is comfortable for you. MNPP should be used as a guide that individuals can adjust and adapt to suit their personal ability levels. You should consult a medical practitioner to ensure that this service is suitable for you, especially when pregnant or if you have existing medical conditions. Maias Group Ltd is not responsible for any injury or harm that may be sustained as a result of participating in MNPP.

When participating in any virtual services from Maias Group Ltd, it’s the participants responsibility to ensure that the training space is safe, free of risk and suitable for the desired activity. Responsibility also lies with the participant to ensure that they are wearing suitable clothing and that they’re in an appropriate physical and mental state to engage with the activity safely. If at any point the participant are experiencing any discomfort, pain, dizziness or other unexpected side effects in relation to MNPP services the activity should cease and you should seek urgent medical advice.

Qualified Personnel

Netball Coaches: Providing netball specific guidance throughout MNPP. This is designed to support not replace an individuals existing netball training. It’s the participants responsibility to adapt and adjust MNPP to their current training schedule.

Physiotherapist: Providing general guidance on the “physio” section of MNPP only. All physio advice within MNPP is designed to provide general guidance to participants and isn’t a tool that should be used to rehabilitate new or existing injuries. Individual feedback and advice is not available.

Yoga Instructor: Providing general guidance sessions on the “recovery” section of MNPP only. Individual feedback and advice is not available.
